Civil Aviation (Air Travel Organisers’ Licensing) Regulations 2012
These regulations are a major reform of the protection of air passengers against the insolvency of travel companies. In particular they create the concept of ‘Flight-Plus’ which brings a number of travel agents within the scope of the regulations who were previously outside the regulatory regime.
The Consumer Protection from Unfair Trading Regulations 2008 (SI 2008 No. 1277)
These regulations create criminal offences for those who practise unfair commercial practices. They replace the provisions of the Trade Descriptions Act 1968 relating to false trade descriptions and the provisions of the Consumer Protection Act 1987 relating to misleading price indications.
The Package Travel, Package Holidays and Package Tours Regulations 1992 (SI 1992 No. 3288)
These are the 1992 Regulations, as amended in 1995 and 1998, which transpose the Package Travel Directive (EC/314/90) into UK law.
The Unfair Terms in Consumer Contracts Regulations 1999 (SI 1999 No. 2083)
These Regulations revoke and replace the Unfair Terms in Consumer Contracts Regulations 1994 (S.I. 1994/3159) which came into force on 1st July 1995.
The Regulations apply, with certain exceptions, to unfair terms in contracts concluded between a consumer and a seller or supplier (regulation 4). The Regulations provide that an unfair term is one which has not been individually negotiated and which, contrary to the requirement of good faith, causes a significant imbalance in the parties’ rights and obligations under the contract to the detriment of the consumer (regulation 5).
